These Terms & Conditions govern your use of the Wild Colt Tack & Supply website and the purchase of products from us. By accessing this website or placing an order, you agree to be bound by these Terms in accordance with the laws of the Republic of South Africa.
Wild Colt Tack & Supply (“Wild Colt”, “we”, “our”, “us”) operates as an online retail business within South Africa.
GENERAL
1.1 All prices are listed in South African Rand (ZAR).
1.2 Wild Colt reserves the right to amend pricing, product information, and these Terms at any time without prior notice.
1.3 It is the customer’s responsibility to review these Terms before placing an order.
1.4 These Terms are governed by the laws of South Africa, including the Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA).
1.5 Nothing in these Terms excludes or limits any rights a consumer may have under the Consumer Protection Act where such exclusion is not permitted by law.
WEBSITE DISCLAIMER
2.1 The contents of this website are provided “as is” without warranties of any kind, whether express or implied, including but not limited to accuracy, completeness, merchantability, or fitness for a particular purpose.
2.2 Wild Colt shall not be liable for errors or omissions in website content.
2.3 We reserve the right to modify, suspend, or withdraw any part of the website without prior notice.
2.4 Wild Colt shall not be liable for temporary unavailability due to technical issues beyond our control.
PRODUCT INFORMATION & AVAILABILITY
3.1 We make every effort to ensure product descriptions, specifications, images, and pricing are accurate.
3.2 Product colours may vary due to screen settings and lighting.
3.3 Certain products may be supplier-ordered or made-to-order upon purchase.
3.4 Stock availability is subject to supplier availability.
3.5 If a product becomes unavailable after purchase, Wild Colt will notify the customer and issue a refund where applicable.
ORDERS & PAYMENT
4.1 Orders are confirmed only once full payment has been received and cleared.
4.2 Wild Colt reserves the right to cancel or refuse any order due to stock unavailability, pricing errors, suspected fraud, or payment issues.
4.3 Cancellation of standard in-stock items prior to dispatch is permitted, subject to a reasonable administrative and handling fee of 10% of the total purchase price to cover processing, packaging, restocking, and transaction costs incurred, as well as deduction of any non-refundable payment processing fees.
4.4 Orders for made-to-order or supplier-ordered products may not be cancelled once production or procurement has commenced.
4.5 Wild Colt reserves the right to refuse cancellation requests where costs have already been incurred.
ORDER PROCESSING
5.1 Orders are processed Monday to Friday only.
5.2 Weekends and South African public holidays are excluded from processing times.
5.3 Orders placed after 14:00, on weekends, or public holidays will be processed on the next business day.
5.4 Processing time is 1–3 business days after payment confirmation unless otherwise stated.
5.5 Business days refer to Monday through Friday, excluding public holidays.
SHIPPING & DELIVERY
6.1 Wild Colt uses The Courier Guy for deliveries within South Africa.
6.2 Deliveries are made to physical street addresses only. PO Box addresses are not accepted.
6.3 Estimated delivery time is 3–7 business days from dispatch, depending on location.
6.4 Delivery time frames are estimates and not guaranteed.
6.5 Wild Colt is not responsible for courier delays caused by public holidays, high-volume periods, adverse weather, or circumstances beyond our control.
6.6 Delivery is confirmed upon signature or secure PIN confirmation at the delivery address.
6.7 Once dispatched, a tracking number will be provided.
6.8 It is the customer’s responsibility to monitor tracking updates and ensure availability for delivery.
RISK & DAMAGE IN TRANSIT
7.1 Risk passes to the customer upon confirmed delivery.
7.2 Customers must inspect parcels immediately upon receipt.
7.3 Any visible damage must be reported within 24 hours of delivery.
7.4 Claims must include clear photographs of packaging, shipping label, and product.
7.5 Failure to report damage within 24 hours may result in the claim being declined.
COOLING-OFF PERIOD (ONLINE PURCHASES)
8.1 In accordance with ECTA, customers may cancel an online purchase within 7 days of receiving goods.
8.2 To qualify, the item must be completely unused, not fitted, worn, ridden in, or tested, in original packaging, and fully resellable.
8.3 Products showing signs of fitting, hair, dirt, odour, wear, environmental exposure, or use will not qualify for return.
8.4 Return courier costs are the responsibility of the customer.
8.5 Where cancellation occurs under the cooling-off period, Wild Colt may deduct a reasonable administrative and handling fee of 10%, original courier costs, return courier costs if arranged by Wild Colt, payment processing fees, and any loss in value due to diminished condition.
8.6 All returns are subject to inspection and approval before any refund is processed.
DEFECTIVE GOODS (CPA COMPLIANCE)
9.1 Customers may return goods within 6 months only if the product is defective due to a manufacturing fault present at the time of supply.
9.2 A defect refers to a material manufacturing fault that renders the product unsafe or unsuitable for its intended purpose under normal and reasonable use.
9.3 Wild Colt shall not be liable for damage resulting from incorrect fitting or adjustment, misuse, abuse or negligence, environmental exposure including sand, salt, humidity or water, normal wear and tear, accidental damage, horse behaviour or excessive force.
9.4 No equestrian equipment is indestructible.
9.5 All defective claims are subject to inspection. Wild Colt reserves the right to repair or replace the product before issuing a refund.
NON-RETURNABLE ITEMS
The following items may not be returned unless defective:
Custom or made-to-order products
Supplier-ordered items once procurement has commenced
Opened supplements
Opened grooming or hygiene products
Clearance or discounted items
Products that have been fitted, worn, or used
MADE-TO-ORDER PRODUCTS
11.1 The following products are made-to-order: Wild Colt Bridles, Breastplates, Martingales, Stirrup sets, Chaps, and Rope halters.
11.2 These products may take up to 14 business days to manufacture before dispatch.
11.3 Production time is separate from courier delivery time.
11.4 Once production has commenced, these orders may not be cancelled.
11.5 Made-to-order items are non-refundable unless defective.
EQUIPMENT USE & SAFETY
12.1 Equestrian activities involve inherent risk.
12.2 Equipment is subject to stress, force, and environmental exposure.
12.3 No equestrian equipment is indestructible.
12.4 Customers are responsible for correct sizing, fitting, and safe use of products.
12.5 Wild Colt shall not be liable for injury, loss, or damage resulting from improper fitting, misuse, negligence, horse behaviour, or failure to follow standard equestrian safety practices.
LIMITATION OF LIABILITY
13.1 Wild Colt shall not be liable for indirect, incidental, or consequential damages, including loss of profit or loss arising from horse injury or behaviour.
13.2 Maximum liability shall not exceed the purchase price of the product in question.
13.3 Nothing in these Terms excludes liability where such exclusion is not permitted under South African law.
FORCE MAJEURE
Wild Colt shall not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, courier delays, supplier shortages, public holidays, weather conditions, load shedding, strikes, or government restrictions.
ENTIRE AGREEMENT
These Terms & Conditions constitute the entire agreement between Wild Colt and the customer and supersede any prior communications or representations.
GOVERNING LAW
These Terms & Conditions are governed by the laws of the Republic of South Africa. South African courts shall have jurisdiction in any dispute.
